NOTICE OF PUBLIC HEARING

 

IN THE MATTER OF THE PALMYRA CEMETERY ASSOCIATION

IN THE COURT OF COMMON PLEAS, LEBANON COUNTY, PENNSYLVANIA

CIVIL ACTION-LAW & EQUITY

NO. 2008-01518

 

The Borough of Palmyra, Palm Lutheran Church, and Trinity United Church of Christ have agreed to settle a dispute regarding the management, maintenance, operation, and ownership of the Palmyra Cemetery Association, and custody of the assets of the Palmyra Cemetery Association, including the Palmyra Cemetery and have requested the Court of Common Pleas of Lebanon County, Pennsylvania, to conduct a public hearing to consider the Mutual Settlement and Release Agreement of those parties. At the Hearing the Court will consider the following matters:

 

a)      Approval of the Settlement and Release Agreement among the Borough of Palmyra, Palm Lutheran Church, and Trinity United Church of Christ regarding the Palmyra Cemetery Association and the Palmyra Cemetery as well as all of the assets of the Palmyra Cemetery Association.

b)      Appointment of the Borough of Palmyra as Custodian of all of the assets of the Palmyra Cemetery Association.

c)      Confirmation that Palm Lutheran Church and Trinity United Church of Christ are not legally responsible for the management, maintenance, and operation of the Palmyra Cemetery and the Palmyra Cemetery Association.

d)      Appointment of the Borough of Palmyra as the custodian of the assets of the Palmyra Cemetery Association and to take any and all steps, without further order of Court, to sell, lease, or otherwise liquidate any of the land of the Palmyra Cemetery Association not being used for burial pruposes and to convey good and marketable title to said unused land to third parties, provided, however, that the proceeds from the sale, lease or other disposition of said unused land in the cemetery shall be utilized by the Borough of Palmyra for the maintenance, upkeep, and care of the cemetery.

e)      Authorization of the use of Palmyra Cemetery Association funds to pay for the costs of this Notice by Publication.

 

Any person or person who may be owners of any burial right in the Palmyra Cemetery or who may have a claim to any funds presently being held in the name of the Palmyra Cemetery Association shall appear at the hearing in this matter and present their claim.

The hearing on these matters shall be held on the 1^st day of May, 2012, at 8:30 a.m. in Courtroom No. 3, Lebanon County Municipal Building, 400 South Eighth Street, Lebanon, Pennsylvania, 17042, before the Honorable Bradford H. Charles, Judge.

You are warned that if you fail to do so the case may proceed without you and the Court may enter a decision upon the Motion to Approve the Settlement and Release Agreement of the Borough of Palmyra, Palm Lutheran Church of Palmyra, and Trinity United Church of Christ of Palmyra. Such a decision may be entered against you without further notice based upon the relief requested by the Borough of Palmyra, Palm Lutheran Church, and Trinity United Church of Christ. You may lose money or property or other rights important to you.
