Sandra Weitzel and George Weitzel, v. Mount Zion Fire Company

 

Civil Action-Law-Negligence-Trip and Fall-Private Facility-Private Party-Step to Bathroom-Motion for Summary Judgment-Status of Guest-Duty of Care-Invitee-Licensee-Open and Obvious Condition-Questions of Fact

 

Sandra Weitzel and George Weitzel (“Plaintiffs”) filed causes of action against Mount Zion Fire Company (“Defendant”) based upon alleged injuries sustained by Plaintiff Sandra Weitzel when she fell at a private party held on premises owned by Defendant.  Defendant filed a Motion for Summary Judgment, asserting that the case is precluded on the basis that Plaintiff Sandra Weitzel was a licensee at Defendant’s facility to whom a lesser duty of care was owed and the condition of the premises where she fell had been an open and obvious one that precludes liability.

 

  1. The court properly may grant summary judgment when the record clearly establishes that there is no genuine issue of material fact and the moving party is entitled to judgment as a matter of law.

 

  1. Even if there is no dispute concerning material facts, summary judgment should not be granted if those facts support conflicting inferences, as all inferences must be made in favor of the nonmoving party.

 

  1. In a negligence case, the duty of care owed by a possessor of land is determined based upon the status of the entrant, which includes that of an invitee to which the highest duty of care is owed, a licensee and a trespasser, to which a lesser duty of care is owed.

 

  1. The determinative factor regarding the status of a guest hinges upon the presence of the guest on the premises as a result of an invitation or permission from the owner, which generally is a question for the jury.

 

  1. In light of the fact that the determination of whether Plaintiff Sandra Weitzel qualified as an invitee or licensee is question of fact for the jury, summary judgment is not appropriate on this basis.

 

  1. A possessor of land is not liable to an invitee for physical harm caused by any activity or condition upon the land whose danger is known or obvious unless the possessor should anticipate the harm despite such knowledge of obvious appearance.

 

  1. A condition is deemed obvious when both the condition and the risk are apparent to and would be recognized by a reasonable person in the position of the visitor exercising normal perception, intelligence and judgment.

 

  1. While determination of whether a condition is open and obvious generally is a question of fact, the determination may be made by the court where reasonable minds could not differ as to a conclusion.

 

  1. Despite the fact that Plaintiff Sandra Weitzel received several warnings about the step through family members, postings and previous navigation of the area, the step upon which it is alleged Plaintiff Sandra Weitzel fell is not commonly present upon entry to a bathroom and the patterns of the floor tiles present may have made recognition of the condition more difficult such that a question of fact exists for the jury regarding whether the condition was open and obvious.
