NOTICE OF PROPOSED ORDINANCE

 

NOTICE IS HEREBY GIVEN that Palmyra
Borough Council at its meeting on Tuesday, October 23, 2012, at 7 p.m. at the Palmyra Municipal Center, 325 South Railroad Street, Palmyra, PA, shall conduct a hearing and at that meeting or at a subsequent meeting held within 60 days of the date of publication of this advertisement, if appropriate, shall enact an ordinance, the caption of which is as follows:

 

An ordinance signifying the desire and intention of the Borough of Palmyra, Lebanon County, PA, to organize an authority under the Municipal Authorities Act, as amended and supplemented, for the purposes of exercising any and all powers conferred by said act; setting forth, in full, the proposed articles of incorporation; appointing members to the board of the authority; authorizing execution of articles of incorporation and doing all matters necessary for creation of said authority; and repealing all inconsistent ordinances or parts of ordinances.

 

The proposed ordinance may be summarized as follows. The preamble sets forth the Borough’s legislative intent to form Palmyra Borough Municipal Authority. In accordance with the Municipal Authorities Act (the “Act”), the ordinance contains the substance of the Articles of Incorporation including the name of the Authority, that it is formed under the Act, and identifies the name of the incorporating municipality, its officers, and the first members of the Board, and provides other matters necessary for incorporation. The ordinance contains provisions authorizing Borough officials to take all actions the Act requires to incorporate the authority. A copy of the proposed ordinance may be examined without charge at the offices of this newspaper, at the Law Library of the Lebanon County Courthouse, 400 South Eighth Street, Room 305, Lebanon PA and at the Palmyra Municipal Center, 325 South Railroad Street, Palmyra, PA, Mondays through Fridays from 8 a.m. until 4:30 p.m. A copy of the proposed ordinance may be obtained for the cost of reproduction at the Palmyra Borough Municipal Center during the above hours.
