Civil Action-Family Law-Life Threatening Injury to Infant-Natural Parents-Indicated Abuse Finding-Adoption-Post Adoption Contact Agreement-Best Interest of the Child-Substantial Compliance
S.Y. (“Child”) was hospitalized when he was four (4) months’ old with life threatening injuries including intercranial and bilateral retinal hemorrhaging secondary to shaken baby syndrome he sustained while he was in the care of natural mother and father. Delaware County Children and Youth Services (“CYS”) determined indicated findings of abuse with regard to natural mother and father. Following Child’s release from the hospitalization nearly two (2) months after the incident, Child was placed in the care of adoptive mother. Approximately four (4) years later, CYS changed the goal from Child’s reunification with natural parents to adoption. Termination of parental rights proceedings followed. Natural mother and maternal grandmother contested termination of parental rights. Natural mother and grandmother entered into a Post Adoption Contact Agreement with adoptive mother giving adoptive mother permission to proceed with the adoption and natural mother and grandmother the ability to have post adoption contact with Child. The Agreement contained a provision that visits according to the Agreement would occur in accordance with any recommendations by a mental health professional treating Child if such a professional were to advise a change in the visitation. Natural mother and grandmother had contact with Child pursuant to the Agreement for approximately eight (8) months after the execution of the Agreement. Following that time, adoptive mother suspended visits after Child’s therapy provider indicated that visits with the natural mother and grandmother no longer were in Child’s best interest. Following adoption of Child by adoptive mother, natural mother and grandmother filed Petitions to Enforce the Post Adoption Contact Agreement.
- A post adoption contract pursuant to Title 23 Pa.C.S. § 2738 must be in writing and accompanied by an affidavit setting forth that it was entered knowingly, voluntarily and without coercion, fraud or duress.
- A post adoption contract must be approved by the court on or before the date on which an adoption is entered.
- In determining whether to approve the a post adoption contract, the court must determine the best interests of the child including the duration and the nature of the relationship between the child and the adopting parent, the duration and nature of the relationship between the child and his or her birth relatives, any evidence of abuse or neglect of the child, the adjustment of the child to the current environment, the willingness and ability of the adoptive parent and the birth parent to appreciate and to respect the bond of the child with the other party.
- Enforcement of a post adoption contract will be authorized only if there is clear and convincing evidence that enforcement serves the needs, welfare and best interest of the child and if the party seeking enforcement is in substantial compliance with the contract.
- Strict enforcement of the Post Adoption Contact Agreement currently is not in the best interest of Child where Child sustained severe, life-threatening injuries while in the care of natural mother, Child has developed a strong bond with adoptive mother over the years he has been in her care, adoptive mother recognizes Child’s special needs and works hard to meet those needs, natural mother and grandmother do not have the same recognition of the Child’s special needs and Child requires stability and a normal routine that may be disrupted by visits with natural mother and grandmother.
- Enforcement of the Post Adoption Contact Agreement may be in Child’s best interest in the future if natural mother and grandmother educate themselves regarding Child’s special needs and when Child gains maturity to better understand why natural mother and grandmother will play a role in his life.
